1. Purpose

This Fair Use Policy ("Policy") governs acceptable use of the callchloe.ai service. It exists to ensure that all subscribers enjoy reliable, high-quality service and that our infrastructure remains stable and affordable for everyone.

This Policy is part of and supplements our Terms of Service. By using callchloe.ai, you agree to comply with this Policy. Capitalized terms not defined here have the meanings given in our Terms of Service.

2. One Agent, One Account

Each callchloe.ai account is for a single licensed real estate professional. Your account and AI secretary are configured to represent one agent with one professional identity.

Rule: One account per agent. One agent per account. Teams, brokerages, or partnerships requiring multiple secretaries must maintain separate accounts for each agent.

  • The account holder must be the real estate agent whose name, brand, and business the secretary represents
  • The agent on the account must be a licensed real estate professional in Canada or the United States
  • Administrative assistants or staff may access the dashboard on the agent's behalf, but the account must remain in the licensed agent's name

3. One Forwarding Number

Each account supports one registered call forwarding number at a time. This is the phone number from which calls are forwarded to your AI secretary.

  • One number per account โ€” Your secretary is linked to a single phone number (your business line or cell)
  • Number changes are limited to 2 per month โ€” To prevent abuse, you may change your forwarding number a maximum of twice per billing cycle
  • SMS verification required โ€” Every forwarding number change requires SMS verification to the new number
  • If you need to change your number more than twice in a month, contact [email protected] and we will review on a case-by-case basis

4. Real Estate Calls Only

callchloe.ai is designed exclusively for real estate professionals handling real estate-related calls. The AI secretary is trained for real estate scenarios and should only be used for that purpose.

Permitted Uses

  • Calls from prospective buyers wanting to schedule showings
  • Calls from prospective sellers interested in listing their property
  • Calls to reschedule or cancel existing appointments
  • General real estate questions from potential clients
  • Callback requests from leads
  • Follow-ups on listed properties

Prohibited Uses

  • Forwarding non-real-estate business calls (e.g., insurance, mortgage brokering, general business lines)
  • Using the service as a general-purpose answering service or call center
  • Forwarding calls from multiple different businesses to one account
  • Any use that does not involve legitimate real estate call handling

5. No Account Sharing

Your callchloe.ai account, login credentials, and AI secretary are for your exclusive use as the registered agent.

โš ๏ธ Prohibited: Sharing your account with other agents, forwarding another agent's calls through your account, or allowing anyone else to use your secretary as if it were their own.

  • You may not share login credentials with other agents
  • You may not forward calls from other agents' phone numbers to your secretary
  • You may not sublicense or provide access to the service to any third party
  • Your office assistant or admin may access your dashboard with your credentials for administrative purposes โ€” this is permitted

6. No Reselling

You may not resell, rebrand, white-label, or redistribute the callchloe.ai service in any form.

  • You may not charge other agents for access to your account or secretary
  • You may not offer the service as part of a separate product or bundle
  • You may not create derivative services based on callchloe.ai's technology
  • Brokerage owners wishing to provide secretaries to their agents should contact us about our team pricing at [email protected]

7. Minute Usage & Included Minutes

Each plan includes a monthly allocation of call minutes:

  • Minutes are calculated per call โ€” Each call is rounded up to the nearest minute (e.g., a 1 min 12 sec call = 2 minutes billed)
  • Minutes reset on your billing date โ€” Unused minutes do not roll over to the next month
  • Usage alerts are sent at 80% and 100% โ€” You will receive an SMS and email notification when you reach 80% and 100% of your included minutes
  • You can monitor your real-time usage at any time in your dashboard

8. Overage Billing

If you exceed your included monthly minutes, additional minutes are billed at $0.35 USD per minute on both plans.

How overage works: Your service is never interrupted. Once you exceed your plan's minutes, each additional minute is automatically billed at $0.35. Overage charges are charged to your card on file at the end of your billing cycle.

  • Overage is charged to the credit card on file
  • Overage charges appear as a separate line item on your invoice
  • There is no cap on overage โ€” the service continues uninterrupted
  • If you consistently exceed your plan minutes, we recommend upgrading your plan or purchasing a top-up bundle for better per-minute rates

9. Top-Up Minutes

You can purchase additional minute bundles at any time from your dashboard. Top-up minutes are added to your account instantly.

  • Top-up minutes are used before overage billing kicks in
  • Top-up minutes are non-refundable
  • Top-up minutes do not roll over โ€” they expire at the end of the billing cycle in which they were purchased
  • Top-up minutes are consumed after your plan's included minutes are exhausted

10. Demo Call Limits

The live demo number on our website allows prospective users to experience the AI secretary before signing up. Demo calls are subject to the following limits:

  • Maximum 2 minutes per demo call โ€” The call will end automatically after 2 minutes
  • Email required โ€” You must provide a valid email address to access the demo
  • Limited to reasonable use โ€” The demo is intended for evaluation only, not repeated or excessive use
  • We reserve the right to restrict or block access to the demo number in cases of abuse

11. Abnormal Usage Patterns

We monitor usage patterns to protect the quality and stability of the service for all users. The following patterns may be flagged as abnormal:

  • Unusually high call volume โ€” Volumes significantly exceeding typical real estate agent usage (e.g., hundreds of calls per day)
  • Non-real-estate calls โ€” Calls that do not relate to real estate transactions, showings, or client inquiries
  • Automated or bot-generated calls โ€” Calls originating from auto-dialers, robocall systems, or any automated source
  • Calls from multiple distinct forwarding numbers โ€” Suggesting the account is being shared across agents
  • Calls with no meaningful content โ€” Repeated silent calls, hang-ups, or calls designed to consume minutes without legitimate purpose
  • Sudden usage spikes โ€” A dramatic increase in usage inconsistent with the account's history

12. Monitoring & Enforcement

callchloe.ai uses automated and manual monitoring to enforce this Fair Use Policy:

  • Automated monitoring: Our systems track minute usage, call frequency, forwarding number changes, and usage patterns to detect anomalies
  • Manual review: Flagged accounts are reviewed by our team before any action is taken
  • Good faith: We always assume good faith first. If your usage is flagged, we will contact you before taking any restrictive action

We do not listen to or review the content of your calls for enforcement purposes. Monitoring is based on metadata (call volume, duration, frequency, and patterns) only.

13. Violations & Consequences

If we determine that a Fair Use Policy violation has occurred, we may take one or more of the following actions, depending on the severity:

โš ๏ธ Important: Account termination for Fair Use Policy violations is non-refundable. Any remaining subscription time, included minutes, or top-up minutes are forfeited. Annual plan subscribers are not entitled to a prorated refund.

14. Appeals

If you believe a Fair Use Policy enforcement action was taken in error, you have the right to appeal:

  • Send an appeal to [email protected] within 14 days of the enforcement action
  • Include your account email, a description of the situation, and any supporting information
  • We will review your appeal within 5 business days and respond with a final decision
  • During the appeal period, the enforcement action remains in effect unless we determine otherwise

15. Changes to This Policy

We may update this Fair Use Policy from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance. The "Last Updated" date at the top of this page will be revised accordingly.
